General conditions of participation
Raffle tickets for Green Peak Festival
1. Subject matter
These participation conditions regulate participation in the competition organised by AGRANA Beteiligungs-AG. Participation in the competition is exclusively on the basis of the conditions set out here which are explicitly acknowledged by every participant through their respective participation. The competition is being advertised on the profile of AGRANA Beteiligungs-AG on Facebook, Instagram and LinkedIn but is in no way linked to Facebook, Instagram and LinkedIn and is neither sponsored, supported nor organised by Facebook, Instagram and LinkedIn.
The respective contact person and responsible party is solely AGRANA Beteiligungs-AG.
2. Participation
Participation in the competition is free of charge, voluntary and entails no purchase obligation. The competition is only open to individuals resident in Austria aged 18 or above on the starting date of the competition, namely 05 September 2022, who are not employees of AGRANA Beteiligungs-AG. The competition starts on 05.09.2022 and ends on 14.09.2022 at 23:59 CEST (participation period). The winners will be drawn on 15.09.2022.
3. Prize
The following prize is available: Tickets for the Green Peak Festival. No correspondence will be entered into with regard to the competition. Prizes cannot be exchanged for cash. Assigning prizes to other individuals is subject to the prior written approval from AGRANA Beteiligungs-AG. Any recourse to courts of law is excluded.
4. Participant obligations
Participants relying on unauthorised aids, otherwise cheating or violating the participation conditions shall be excluded from participating in the competition. In such cases, prizes may also be revoked and their return demanded.
The competition and associated contents may not be used by participants or third parties for commercial purposes. In particular, the competition, its associated contents, access to the participation form and prizes may not be offered for sale or later used for any other commercial purposes. The competition may not be adapted, copied, distributed or duplicated.
5. Implementation of the competition
The prizes shall be drawn after the end of the participation period in camera and based purely on chance. The winner shall be contacted by the event organiser using the contact details provided. The winner alone is responsible for ensuring the accuracy and completeness of the contact details provided.
Prizes not collected shall forfeited 20 days after the winner has been advised thereof in as far as these do not become worthless earlier on the grounds of their specific nature (e.g. a weekend trip) without any entitlement to other forms of compensation. Winners shall be deemed to have been advised once a notification has been sent via post, email or telephone, as decided upon by AGRANA Beteiligungs-AG. From this point in time, all risks shall be borne by the winner. Providing incorrect data during the registration procedure for the competition may lead to participants being excluded from participation.
Participants are not obligated to accept any prizes won. Legal recourse, a cash alternative, payment in kind or any exchanging of prizes is not permitted.
6. Liability
AGRANA Beteiligungs-AG accepts no liability for any technical defects, data transmission errors or with regard to any specific characteristics or a specific utility of the prizes made available.
AGRANA Beteiligungs-AG shall solely be liable for any losses or damage directly attributable to intentional or gross negligence on its part. Other than in cases involving personal injury or death, any further liability is hereby excluded. Any liability and/or guarantee pertaining to foregone chances of winning are likewise excluded.
7. Miscellaneous
No guarantees are provided at any time pertaining to the availability and functionality of the competition. The event organiser retains the right to interrupt or terminate the competition at any point in time without prior announcement nor the need to disclose the grounds therefor. In particular, the event organiser may resort to this option if it is not possible to guarantee the correct implementation of the competition on technical grounds or any other grounds. The event organiser retains the right to revise or supplement the participation conditions at any time without being required to disclose the reasons therefor. The competent court of law in Vienna alone shall resolve any disputes arising in connection with the competition.
Data protection notice
Pursuant to Article 6 (1b) of the GDPR, every participant consents to their personal data being stored and processed for marketing and advertising purposes by AGRANA Beteiligungs-AG.
Data shall only be disclosed to third parties in as far as this is necessary in connection with holding the competition (e.g. shipping a prize via a logistics company) or for publishing details of the winners. We essentially exclude any other transmission of data to third parties.
Participants’ personal data will be deleted after the close of the competition and the announcement of the winners.
